  • Postgraduate Medical Programs: MD/MS specializations in Germany, UK, USA, Australia, Canada, and New Zealand
  • Nursing Programs: International nursing degrees and career opportunities in various countries
  • Allied Health Programs: Physiotherapy, pharmacy, and paramedical courses abroad

2.2 Consultation Services Include:

2.3 No-Commission Approach

Following Qogent Global's core philosophy since 2014, we operate on a transparent, merit-based approach. We do not receive commissions from universities for student admissions. Our recommendations are based solely on student merit and suitability. All fees are clearly disclosed and charged directly to students for our consultancy services.

3. User Responsibilities and Conduct

3.1 Eligible Users

Our services are intended for:

  • Students aged 16 and above considering medical education abroad
  • Medical graduates seeking postgraduate opportunities
  • Parents and guardians of prospective students
  • Healthcare professionals exploring international career options

3.2 User Obligations

By using our services, you agree to:

  • Provide accurate, complete, and truthful information
  • Maintain the confidentiality of your account credentials
  • Use the Service only for lawful purposes

4.4 Recognition and Licensing

While we focus on NMC (National Medical Commission) approved and WHO-recognized institutions, students are responsible for:

5. Intellectual Property Rights

  • Payment is required before service delivery begins

6.2 Refund Policy

  • Consultation fees are generally non-refundable once services begin
  • 48-hour cancellation window available for full refunds
  • Refunds will be processed within 7-14 business days
  • University application fees paid to institutions are non-refundable
  • Visa fees and related charges are non-refundable
  • Refunds may be considered in exceptional circumstances at company discretion

6.3 Third-Party Costs

Students are responsible for all third-party costs including but not limited to:

  • University application and tuition fees
  • Visa application fees and related charges
  • Medical examinations and health insurance
  • Travel and accommodation expenses
  • Document attestation and translation costs

7. Limitation of Liability

7.1 DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 Limitation of Damages

To the maximum extent permitted by law, QogentMed shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Denial of university admission or visa rejection
  • Changes in university policies or immigration rules
  • Delays in processing or communication
  • Personal or professional disappointment

7.3 Maximum Liability

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount paid by you to us in the 12 months preceding the claim.

8. Indemnification

You agree to defend, indemnify, and hold harmless QogentMed, its officers, directors, employees, and agents from and against any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any false or misleading information you provide

9. Termination

9.1 Termination by You

You may stop using our Service at any time. Notify us if you wish to terminate ongoing consultancy services.

9.2 Termination by Us

We may terminate or suspend your access immediately, without prior notice, for:

  • Breach of these Terms
  • Fraudulent or illegal activities
  • Abuse of our services or staff
  • Non-payment of fees

9.3 Effect of Termination

Upon termination:

  • Your right to use the Service will cease immediately
  • We may delete your account and data
  • Outstanding obligations will survive termination
  • Confidentiality obligations continue indefinitely

10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. While Qogent Global operates internationally with offices in UAE, USA, and India, applicable laws include:

  • Indian Contract Act, 1872
  • Consumer Protection Act, 2019
  • Information Technology Act, 2000
  • Foreign Exchange Management Act (FEMA), 1999

10.2 Jurisdiction

Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Bangalore, Karnataka, India.

10.3 Dispute Resolution

Before initiating legal proceedings, we encourage:

  • Direct communication to resolve issues amicably
  • Mediation through recognized mediation centers
  • Arbitration under the Arbitration and Conciliation Act, 2015

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective:

  • 30 days advance notice for fee structure changes

Your continued use of the Service after changes constitutes acceptance of the new Terms.
